Agreement to Terms

By downloading, installing, or using MediVision ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Use of the App

Intended Use

MediVision is intended to:

• Help you track and organize health information
• Provide general educational information about symptoms
• Assist in preparing for healthcare appointments
• Help locate healthcare providers in your area

Prohibited Uses

You agree NOT to use the App to:

• Make medical decisions without consulting a healthcare provider
• Delay or avoid necessary medical care
• Self-diagnose or self-treat medical conditions
• Provide medical advice to others based on App output
• Use in any way that violates applicable laws or regulations

User Responsibilities

You are responsible for:

• The accuracy of information you enter into the App
• Verifying any information with qualified healthcare providers
• Seeking appropriate medical care for health concerns
• Maintaining the security of your device

Subscription Terms

Premium Features

MediVision offers premium features through auto-renewable subscriptions:

Free Trial

New users may be eligible for a free trial period. After the trial:

• Your subscription will automatically convert to a paid subscription
• You will be charged unless you cancel before the trial ends

Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• To cancel: Go to Settings > Apple ID > Subscriptions on your iOS device

Refunds

Refund requests are handled by Apple according to their App Store policies. We do not process refunds directly.

Intellectual Property

Our Rights

MediVision and its content, features, and functionality are owned by us and are protected by:

• Copyright laws
• Trademark laws
• Other intellectual property rights

Your License

We grant you a limited, non-exclusive, non-transferable license to:

• Download and install the App on your personal device
• Use the App for personal, non-commercial purposes

Restrictions

You may NOT:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Use the App for commercial purposes without permission
• Remove any copyright or proprietary notices

Limitation of Liability

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF HEALTH INFORMATION

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Any loss of profits, data, or goodwill
• Any damages arising from use of or inability to use the App
• Any damages arising from reliance on App information

Maximum Liability

Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding any claim.

Indemnification

You agree to indemnify and hold harmless MediVision and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

California Regulatory Compliance

AI Transparency (AB 489)

In compliance with California Assembly Bill 489, we disclose that MediVision uses artificial intelligence to provide health information. The AI system:

• Does NOT use terms implying it is a licensed healthcare professional
• Does NOT represent itself as a doctor, nurse, or medical provider
• Clearly identifies itself as an AI-powered tool

User Disclosure (SB 243)

In compliance with California Senate Bill 243, MediVision:

• Discloses that you are interacting with AI, not a human
• Provides periodic reminders during extended use that the system is AI-powered
• Implements safeguards regarding sensitive health topics

Changes to Terms

We may modify these Terms at any time. If we make material changes:

• We will notify you through the App or by other means
• Your continued use after changes constitutes acceptance

Termination

We may terminate or suspend your access to the App:

• For violation of these Terms
• At our discretion, without prior notice

Upon termination, your license to use the App ceases immediately.

Governing Law & Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Informal Resolution

Before filing any claim, you agree to try to resolve the dispute informally by contacting us.

Arbitration

Any dispute not resolved informally shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

Additional Terms

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and MediVision regarding use of the App.
